ROMANIA: Energy and gas suppliers and traders from other EU states can operate more easily in Romania. Restrictions raised by ANRE – project

A draft order of the Energy Regulatory Authority (ANRE), recently put into public debate, removes the restrictions that an electricity or gas supply and trading company that is not registered in Romania had to operate on the market our.

The ANRE order, which is at the draft stage, refers to the “modification of the Procedure for confirming the right to participate in the electricity/natural gas markets in Romania of foreign legal entities having their headquarters in a member state of the European Union”.

In fact, the new regulation primarily exempts a supply or trading company registered in another EU country from the obligation to establish and maintain a financial guarantee in the form of a letter of bank guarantee or cash collateral, in the amount of 1 million euros, equivalent in lei, as is happening now.

Consequently, these companies no longer have to provide “proof of holding a separate account available in RON opened at the State Treasury units within the competent central fiscal bodies, coded with the tax identification code of the payer”, after the order will be adopted.
